Gambling - organization of poker tournaments and other poker events in Berlin that are not organized by the casinos

In Berlin, poker may generally only be operated by the state-licensed casinos (Spielbanken). Anyone who organizes, participates in, or advertises public gambling beyond this without official permission is committing a criminal offense under Sections 284 (1), (4) and 285 of the Criminal Code (Strafgesetzbuch, StGB). Public gambling exists when there is an opportunity to participate for a larger, non-closed group of people, or when it involves gambling habitually organized in clubs or other closed groups. Poker can be organized as a harmless recreational game if it is played without any stake and the only prize consists of the honor of being the winner. In this case, it constitutes a public entertainment event.
