• The marriage was performed abroad At least one of the spouses is a German national at the time the application is submitted. Or at least one of the spouses is stateless, a homeless foreigner (heimatloser Ausländer), or a recognized foreign refugee with habitual residence in Germany. • OR: The marriage was performed in Germany You had the marriage performed in Germany before an authorized person (for example, at the consulate of your home country), and neither of you held German nationality at the time the marriage was performed. • Right to apply The spouses are entitled to submit the application. If both spouses are deceased, the application may also be submitted by their parents or children. • A residence in Germany exists or existed What matters is the residence in Germany of one or both spouses at the time the application is submitted, or failing that, the residence in Germany of the person submitting the application. If there is currently no residence in Germany, the last German residence is decisive. • Note: If neither at least one of the spouses nor the applicant has ever had a residence in Germany (not even as a child), the Standesamt I (Register Office I) in Berlin is responsible, and you need a different service. • Evidence in original or as a certified copy Evidence must be submitted with the application in original or as a certified copy.
