Property - apply for a Nichterstreckungsbescheinigung (certificate of non-extension)

You need a Nichterstreckungsbescheinigung (non-extension certificate) if it is to be confirmed that an encumbrance entered in Section II (Abteilung II) of the land register (Grundbuch) does not spatially extend to a specific part of the property. For the parts of the property that are not affected by the encumbrance, the surveying office (Vermessungsamt) responsible in that location for maintaining the real estate cadastre (Liegenschaftskataster) can issue a Nichterstreckungsbescheinigung. Such certificates may be required, for example, when the individual parts of a property that is to be divided are sold under separate contracts and a priority notice of conveyance (Auflassungsvormerkung) has been entered in Section II of the land register for each contract. It is not always apparent to the land registry office (Grundbuchamt) or a notary which parts of a property are affected, or not affected, by encumbrances. Submitting a Nichterstreckungsbescheinigung makes it easier for the land registry office to make the decisions it must make independently. On this basis, the land registry office can decide on the deletion of the encumbrance for the unaffected part of the property.
