Requirements

• Possession of an unlimited residence permit (Aufenthaltstitel) This includes the Niederlassungserlaubnis (settlement permit), the Erlaubnis zum Daueraufenthalt-EU (EU long-term residence permit), and an unlimited Aufenthaltserlaubnis (residence permit) or Aufenthaltsberechtigung (residence entitlement) issued before 01.01.2005. • Applicability of the Aufenthaltsgesetz (Residence Act) This certificate is not issued to nationals of EU and EEA states or to Swiss nationals. • Local responsibility (Zuständigkeit) The certificate is only issued in Berlin if Berlin is or was the place of last habitual residence (registered address / Meldeanschrift). • Secure livelihood (gesicherter Lebensunterhalt) • The livelihood must be able to be secured independently, without recourse to public benefits under SGB II or SGB XII. • In the case of a marital union with a German national, proof of a secure livelihood is not required. • Minimum period of residence in the federal territory of 15 years In the case of a marital union with a German national, no minimum period of residence needs to be proven. • No grounds for deportation (Ausweisungsgründe) There must be no interest in deportation (Ausweisungsinteresse) under Section 54 (1) nos. 2 to 5 or (2) nos. 5 to 7 of the Aufenthaltsgesetz (AufenthG, Residence Act).

Documents you need

• Application for issuance of a certificate of permanent right of residence • The application can be submitted in person on site. • The certificate can also be applied for in writing from abroad at the Ausländerbehörde (immigration office). • 1 current biometric photo (on photo paper) • 35mm x 45mm, frontal shot with neutral facial expression and closed mouth, looking straight into the camera, light background • Valid passport or passport substitute Together with the passport, the permanent residence permit must be presented if the certificate is applied for before departure. • Power of attorney (Vollmacht) with passport or identity card If an in-person appointment is not possible.
