Mahnbescheid (payment reminder notice) and Vollstreckungsbescheid (enforcement order) - apply for within the German Mahnverfahren (order for payment procedure)

• Initiating the procedure You will find the ways to initiate the procedure under "Required documents". • Participation in the EDA ("Elektronischer Datenaustausch" [electronic data exchange]) mass procedure requires authorization and registration. This involves the issuance of a so-called "Kennziffer" (reference number).

• Mahnantrag (application for a payment order) (individual applications) To initiate a Mahnverfahren (order for payment procedure), you must apply to the Zentrales Mahngericht (Central Court for Payment Order Proceedings) (see "Competent authority") for the issuance of a Mahnbescheid (payment order). The application is subject to a specific form and can be submitted in various ways: • Print out the online Mahnantrag and send it by post (barcode application/printed on paper). This method of submission is no longer permitted for lawyers, registered debt collection service providers, and, since 01.01.2022, also for authorities and legal entities under public law (§ 130 d Zivilprozessordnung [Code of Civil Procedure]). • Submit the online Mahnantrag electronically (using a Personalausweis [identity card] with the online ID function (eID) activated, the besonderes elektronisches Anwaltspostfach (beA) [special electronic mailbox for lawyers], the Notarpostfach (beN) [notary mailbox], the Behördenpostfach (beBPo) [authority mailbox], the elektronisches Bürger- und Organisationspostfach (eBO) [electronic citizen and organisation mailbox], or via Mein Justizpostfach (MJP) [My Justice Mailbox]). • Paper Mahnantrag (official forms available from stationery shops). This method of submission is no longer permitted for lawyers, registered debt collection service providers, and, since 01.01.2022, also for authorities and legal entities under public law (§ 130 d Zivilprozessordnung). • Please do not enclose any supporting documents, receipts, etc. • Follow-up applications (individual applications) and Widerspruch (objection) The Mahngericht will send you all forms still required for the procedure in the appropriate format, or you can fill them out, print them, or download them electronically in the „Online-Mahnantrag" portal (follow-up applications) and send them to the Mahngericht accordingly. This also applies if you are the opposing party and wish to file a Widerspruch. For the Mahnverfahren fee, only half a fee applies under the Gerichtskostengesetz (GKG, Court Costs Act), but at least 38.00 euros (Kostenverzeichnis [schedule of costs] 1100 on § 34 GKG). The "Online-Mahnantrag" (online dunning application) portal calculates the court fee for the particular Mahnverfahren (dunning procedure) and adds the amount automatically while you fill in the form. You can also calculate it yourself using the "Gerichtskostenrechner" (court fee calculator) (see under: "Further information / website of the Mahngerichte [dunning courts] in Germany"). The fee becomes due as soon as the application is received - not only once the respective Mahnbescheid (dunning notice) is issued. You will receive an invoice automatically, without having to request it.
