• Submit the online Mahnantrag electronically (using a Personalausweis [identity card] with the online ID function (eID) activated, the besonderes elektronisches Anwaltspostfach (beA) [special electronic mailbox for lawyers], the Notarpostfach (beN) [notary mailbox], the Behördenpostfach (beBPo) [authority mailbox], the elektronisches Bürger- und Organisationspostfach (eBO) [electronic citizen and organisation mailbox], or via Mein Justizpostfach (MJP) [My Justice Mailbox]).
• Paper Mahnantrag (official forms available from stationery shops). This method of submission is no longer permitted for lawyers, registered debt collection service providers, and, since 01.01.2022, also for authorities and legal entities under public law (§ 130 d Zivilprozessordnung).
• Please do not enclose any supporting documents, receipts, etc.
• Follow-up applications (individual applications) and Widerspruch (objection)
The Mahngericht will send you all forms still required for the procedure in the appropriate format, or you can fill them out, print them, or download them electronically in the „Online-Mahnantrag" portal (follow-up applications) and send them to the Mahngericht accordingly. This also applies if you are the opposing party and wish to file a Widerspruch. Fees
For the Mahnverfahren fee, only half a fee applies under the Gerichtskostengesetz (GKG, Court Costs Act), but at least 38.00 euros (Kostenverzeichnis [schedule of costs] 1100 on § 34 GKG).
The "Online-Mahnantrag" (online dunning application) portal calculates the court fee for the particular Mahnverfahren (dunning procedure) and adds the amount automatically while you fill in the form.
