Land Register (Grundbuch) - Deletion of Land Charges (Grundpfandrechte)

• Application The Grundbuch (land register) procedure is an application-based procedure. Settling the loan debt does not result in an automatic deletion [of the entry].

• Application for deletion and owner's consent The application must be submitted in writing by the owners. Your signatures must be notarially certified for this. Should the creditor submit the application, they must also submit the owner's consent. • Approval of deletion (Löschungsbewilligung) The declaration that the right may be deleted from the Grundbuch (land register) is issued by the creditor (e.g. the bank or credit institution). The signatures must be notarially certified. For banks that use a seal, the seal is required. • Submission of the certificate (Brief) If a Briefgrundschuld (land charge with certificate) or a Briefhypothek (mortgage with certificate) is registered in the land register, the land charge certificate or mortgage certificate must be attached to the application for deletion.
