Waste - Permit for collectors, transporters, dealers and brokers

• Professional qualification The responsible person must have the required specialist expertise and must be able to prove this (see required documents). • Business registration (Gewerbeanmeldung) Your business (Gewerbe) must be registered. • Reliability The owner and the person responsible for managing and supervising the business must, on the basis of their personal characteristics, their conduct and their abilities, be suited to the proper performance of their duties (§ 3 AbfAEV).

• Application: form www.bundesumweltministerium.de/fileadmin/Daten_BMU/Download_ Form for the permit application • Gewerbeanmeldung (business registration) • Extract from the Handelsregister (commercial register) • Auskunft (information/report) from the Gewerbezentralregister (central trade register) The extract from the Gewerbezentralregister (central trade register) must be requested from the responsible Wirtschaftsamt (trade office) (GZR 4, document type 9, for submission to an authority) and must not be older than 3 months. Sole proprietorships (Einzelunternehmen) do not need to provide this document. • Proof of motor vehicle liability insurance (KFZ-Haftpflichtversicherung) including environmental liability insurance (Umwelthaftpflichtversicherung) The motor vehicle liability insurance must cover personal injury of at least 7.5 million euros and property and water damage of 3 million euros. This applies only to collectors and transporters. • Proof of business liability insurance (Betriebshaftpflichtversicherung) and environmental liability insurance (Umwelthaftpflichtversicherung) This is only required if intermediate storage or another activity not related to the use of a motor vehicle is to be carried out. • Führungszeugnis (certificate of good conduct) The Führungszeugnis (certificate of good conduct) must be submitted for the following persons: the business owner, the legal representative of the business owner, the authorized representative partner (vertretungsberechtigter Gesellschafter), the managing director (Geschäftsführer), and the person responsible for managing and supervising the business. The Führungszeugnis (certificate of good conduct) must be requested from the responsible registration office (Meldestelle) (document type "0" for submission to an authority); it must not be older than 3 months and must be submitted in the original. • Personal Auskunft (information/report) from the Gewerbezentralregister (central trade register) This Auskunft must be submitted for the following persons: the business owner, the legal representative of the business owner, the authorized representative partner (vertretungsberechtigter Gesellschafter), the managing director (Geschäftsführer), and the person responsible for managing and supervising the business. The Auskunft must be requested from the responsible registration office (Meldestelle) (GZR 3, document type 9, for submission to an authority); it must not be older than 3 months and must be submitted in the original. • Proof of technical competence (Fachkunde) Under § 3 of the Beförderungserlaubnisverordnung (Transport Permit Ordinance), the person responsible for managing and supervising the business must provide proof of their technical competence (Fachkunde). This proof must be provided by a certificate of participation in a course officially recognized by the authorities. This proof must be resubmitted every 3 years.
