Winter maintenance service on pavements - information on ensuring compliance with the duty to clear snow and grit

• You are an Anlieger (abutting property owner/resident) Anlieger under the Straßenreinigungsgesetz (Street Cleaning Act) are property owners, holders of heritable building rights (Erbbauberechtigte), usufructuaries (Nießbraucher), and holders of a right of use registered in the land register (Grundbuch) • Sidewalks lie in front of the property Winter maintenance service (Winterdienst) must be carried out: • In each case in front of the properties, on the nearest sidewalks running in the same or a similar direction, including the sidewalk sections branching off to the properties or located in areas of corner curb cuts. • On streets without a sidewalk, on the preferred walking surface. • For insufficiently developed streets in category C of the Straßenreinigungsverzeichnis (Street Cleaning Register), there is an extended clearing obligation - continuation of the sidewalk clearing through intersection areas. • You observe the required clearing width In a width required by pedestrian traffic, but at least • 1 meter • 1.5 meters on sidewalks of main roads and shopping streets (category A1/2) • 3 meters in special cases • You carry out winter maintenance service without delay after snow or snow and ice slipperiness occurs • Snow must be cleared without delay after snowfall ends; in the case of continuous snowfall, several times at appropriate intervals. • In the event of snow and ice slipperiness, winter maintenance service must be carried out without delay after it occurs. • If snowfall continues past 8:00 p.m., or if snowfall or the formation of slipperiness occurs after that time, winter maintenance service must be carried out by 7:00 a.m., or by 9:00 a.m. on Sundays and public holidays, of the following day. • You carry out winter maintenance service in full • Clearing of snow • Spreading of abrasive materials (grit) • Removal of ice formations that cannot be countered by spreading • You do not use prohibited de-icing agents for winter maintenance service The use of any de-icing agents, not just salts, is prohibited! • If winter maintenance service is transferred to others: the Anlieger's duty to supervise A suitable third party (company, neighbor, or other person) can be commissioned to carry out winter maintenance service. However, this does not remove the Anlieger's responsibility. The Anlieger is obligated to supervise the proper performance of the work. • For an exemption from winter maintenance service due to incapacity: Physical and economic incapacity service.berlin.de/dienstleistung/326640/ • For an exemption due to undue hardship: exclusion of danger service.berlin.de/dienstleistung/326642/ • In case of violation of winter maintenance obligations: notify the Ordnungsamt (public order office) The Ordnungsämter (public order offices) are responsible for monitoring winter maintenance service on sidewalks. If an Anlieger fails to fulfil this obligation, the Ordnungsamt can arrange for substitute performance (Ersatzvornahme) at that person's expense and conduct administrative fine (Ordnungswidrigkeit) proceedings. A fine of up to 10,000 euros is possible. Reports of missing or insufficient winter maintenance service should therefore be made without delay after being noticed, preferably by telephone, to the Ordnungsamt of the responsible district.
