Condominium Owners' Association Matters (Wohnungseigentumssachen / WEG-Sachen)

• Filing a claim (Klage) The general formal requirements of the ZPO (Zivilprozessordnung, Code of Civil Procedure) apply. In WEG (Wohnungseigentümergemeinschaft, community of owners) matters, the following additional special requirements also apply: • Identification of the claimant and the defendant In the statement of claim, the address of the shared property is initially sufficient to identify the WEG. However, the list of owners with the names and addresses of the other condominium owners (Wohnungseigentümer) must be submitted at the latest by the end of the oral hearing. • Identification of the property manager (Verwalterin/Verwalter) If the property manager of the WEG is a party, representative, or authorized recipient of service (Zustellungsbevollmächtigter), they must be named as well. • Deadline For an action contesting a resolution (Beschlussanfechtungsklage), the one-month time limit for filing the claim after the resolution was passed and the two-month time limit for submitting the statement of grounds after the resolution was passed must be observed.

Processing of the claim depends on payment of a court cost advance (Gerichtskostenvorschuss). As the claimant, you therefore receive a payment request from the court after filing the claim. Only once the court cost advance has been paid does the court serve the claim.

The Amtsgericht (local court) in whose district the property (e.g. an apartment or commercial unit) is located is responsible.
