Lay judges (Schöffinnen und Schöffen) - apply for compensation

• Payment order After the hearing, the judge certifies your service as a lay judge (Schöffe/Schöffin) at the appointment and orders payment of the compensation. • Deadline You may submit the application no later than three months after the end of your current term of office.

• Application for compensation of Schöffinnen and Schöffen (lay judges) (under "Forms") • You will already receive the application form as an attachment to your annual summons (Jahresladung), and again together with the appointment reminder. • Auszahlungsauftrag (payment order) from the hearing date Please enclose with your application the "Auszahlungsauftrag" (payment order) signed by the judge (official designation: HKR 177). You will receive the original and a copy of the "Auszahlungsauftrag" at the end of the hearing. • Verdienstausfallbescheinigung (certificate of loss of earnings) Have you suffered a loss of earnings? If so, please have this certified by your employer. You will receive the form for the Verdienstausfallbescheinigung as an attachment to your annual summons, and again together with the appointment reminder. • Proof of self-employment Are you self-employed? If so, please enclose appropriate proof of your self-employment (e.g. a trade license [Gewerbeschein]) and state your average monthly gross income from self-employed work as well as your regular working hours. • Substantiation of freelance activity Are you working freelance? Please substantiate your freelance activity with suitable documents. Please also state your average monthly income from freelance activity as well as your regular working hours. • Proof of travel costs incurred or other expenses Please prove travel costs incurred for your journey to and from the appointment by means of appropriate receipts and documents (e.g. original tickets, booking confirmations, flight ticket invoices, accommodation costs).

You can submit your written application • by post to the Berechnungsstelle (compensation calculation office) of the Amtsgericht Tiergarten (local court) (which is also responsible for the Landgericht Berlin [regional court]), • by placing it in the letterbox of the Berechnungsstelle (old building, room A 236), or • hand it in after the hearing to the Saalwachtmeisterin or Saalwachtmeister (courtroom usher). • You can also submit your application, or have it recorded for the record, at the Geschäftsstelle (registry) or department responsible for the proceedings in which you served as a Schöffin or Schöffe (lay judge). The Amtsgericht Tiergarten is solely responsible for the compensation of Schöffinnen and Schöffen (lay judges) who serve at the Amtsgericht Tiergarten and the Landgericht Berlin (in each case for criminal matters). If you are an ehrenamtlicher Richter or Richterin (lay judge) at another Berlin court, for example at the Arbeitsgericht (labor court) or Verwaltungsgericht (administrative court), please contact that court regarding your compensation.
