Species protection - applying for an EC certificate of conformity / EC transport permit

• Protected animal/plant species The animal/plant species is listed in Annex A or B of "EC Regulation (EC) No. 338/97." • Legal origin and lawful acquisition of the protected animal/plant species • Additionally for the EC transport permit: appropriate keeping conditions at the destination and consent of the BfN (Bundesamt für Naturschutz, Federal Agency for Nature Conservation) or confirmation from the receiving country The EC transport permit may only be issued • if the competent scientific authority has satisfied itself that appropriate keeping conditions exist at the destination. • If the destination is within Germany, the consent of the Bundesamt für Naturschutz (BfN, Federal Agency for Nature Conservation) is generally required. • If the destination is in another EC member state, the applicant must submit to the issuing authority a confirmation from the Scientific Authority of that EC member state that the accommodation is suitable.

• Application for an EC presentation certificate (EG-Vorlagebescheinigung) or EC transport permit (EG-Transportgenehmigung) • Proof of legal origin Depending on the case, this proof relates to the following information: • Information on prior acquisition (free form of evidence, e.g. old invoices and photos, expert opinions, explanation of the trade route, and submission of accounting records) • Approval from the BfN (Bundesamt für Naturschutz, Federal Agency for Nature Conservation) confirming lawful import (EG-Einfuhrgenehmigung, EC import permit) • Confirmation under species protection law from the recipient country • Captive breeding (confirmation of captive breeding from the nature conservation authority, confirmation of registration, or submission of accounting records, or proof of breeding from the breeder including information on the parent animals) • Legal removal from the wild (exemption permit / exemption granted by the competent authority) • If applicable, informative photos Photos should preferably be submitted digitally. Care must be taken to ensure that they are informative. For live animals, the marking requirements of the Bundesartenschutzverordnung (Federal Species Protection Ordinance) must be observed (photo documentation is permitted, for example, for certain tortoises). • If applicable, further evidence to establish identity (Nämlichkeitssicherung) If there is doubt as to whether the evidence or documents submitted are identical to the specimen named in the application, further evidence must be provided. • Proof of the value of the goods If proof of the value of the goods is not provided, the authority will estimate the value. The value of the goods is the basis for calculating the administrative fees for the certificate.

The fee for the certificate depends on the completeness of the application and the outcome of the review of the application. The basis of calculation is the market value of the specimen. The fee doubles for additional checks or queries. • 15.00 euros: market value up to 200.00 euros • 30.00 euros: market value up to 500.00 euros • 50.00 euros: market value 500.00 to 1,000.00 euros • 75.00 euros: market value 1,000.00 to 2,500.00 euros • 100.00 euros: market value 2,500.00 to 5,000.00 euros • 200.00 euros: market value 5,000.00 to 10,000.00 euros • 300.00 euros: market value over 10,000.00 euros • 15.00 euros: for offspring, for each additional certificate per litter/clutch within the same transaction
