The measure has not yet ended. • There are objections to the way in which a Zwangsvollstreckung (compulsory enforcement) is being carried out This can be the case, for example, if you believe that: • the bailiff refuses to carry out an instruction from the creditor, or seizes an item that in your view is exempt from seizure (unpfändbar) • the enforcement court did not observe statutory requirements when issuing the Pfändungs- und Überweisungsbeschluss (e.g. lack of local responsibility (örtliche Zuständigkeit))

• Legal remedy in written form You must submit the Vollstreckungserinnerung (objection to an enforcement measure) in writing and state the reasons for it. • Evidence relating to the enforcement measure Such evidence can be, for example: • Letter/summons/record from the bailiff (Gerichtsvollzieherin or Gerichtsvollzieher) • Certified copy/copy of the contested measure from the enforcement court (Vollstreckungsgericht)
