Mediation is a procedure in which the parties to a dispute resolve their conflict independently, with the support of specially trained Güterichterinnen and Güterichter (settlement judges). The Güterichterinnen and Güterichter mediate in the conflict, create a constructive atmosphere for discussion, and ensure fair conduct between the parties. However, they have no decision-making authority. They limit themselves to supporting the parties in working out a sensible solution to their problems themselves. What advantages does mediation have over contentious court proceedings? Mediation can be advantageous for the parties to a dispute in many respects • The parties and what they have to say are the focus. • More time is available for resolving the conflict than in a court hearing. • The background to the conflict and the interests of those involved can be worked out and taken into account more effectively. • You decide for yourselves how the conflict is resolved. This way, a viable relationship for the future can be preserved or re-established. • Other conflicts burdening you and the other party may also be resolved and settled. • The appointment (Termin) is not public and is confidential. • If needed, other people who are important for finding a solution can be included in the discussion.
