• Natural person Natural person means that it is not a legal entity (e.g. GmbH, Aktiengesellschaft). • Declarations to be submitted You must state whether you have been finally convicted of an insolvency offense within the meaning of §§ 283 to 283c StGB (Criminal Code), or whether you were granted or denied a discharge of residual debt (Restschuldbefreiung) within the last ten years before the application for the opening of proceedings. These insolvency offenses are bankruptcy (§ 283 StGB), especially serious cases of bankruptcy (§ 283a StGB), violation of accounting obligations (§ 283b StGB), and favoring creditors (§ 283c StGB). If any of these points applies, a deferral is excluded. • Application for discharge of residual debt You can only apply for a deferral of costs if you wish to go through the insolvency proceedings with the aim of becoming debt-free. • No funds to cover costs Due to your economic situation, you are unable to pay the costs. Your income and assets are likely insufficient to cover the costs of the proceedings.

• Regelinsolvenzverfahren (standard insolvency proceedings): Combined application for opening proceedings, granting discharge of residual debt, and deferral of costs (under "Forms") • Verbraucherinsolvenzverfahren (consumer insolvency proceedings): Application for deferral of costs (under "Forms") In consumer insolvency proceedings, the deferral application is not part of the application to open proceedings, so this application must be submitted separately. • Current proof of income e.g. pay statement, Jobcenter notice, basic income support (Grundsicherung) notice, pension notice, or other proof of income • Proof of monthly expenses e.g. rent, service charges (Hausgeld), loan installments, insurance, maintenance payments

• Amtsgericht Charlottenburg (Charlottenburg Local Court): For standard insolvency proceedings (Regelinsolvenzverfahren), the application for deferral of costs (Kostenstundung) must be submitted to the Amtsgericht Charlottenburg. • Amtsgericht (Local Court): For consumer insolvency proceedings (Verbraucherinsolvenzverfahren), the application must be submitted to the Amtsgericht at the applicant's place of residence. Exception: If an application for the opening of proceedings was first filed by a creditor (a so-called Fremdantrag, or third-party application), then the deferral application must be submitted to the Amtsgericht Charlottenburg, since the creditor's application is also processed there.
