Experts (Sachverständige) - Apply for compensation in criminal and administrative fine proceedings

• Commissioning to prepare an expert opinion (Gutachten) You must have been commissioned by the court or the investigating authority to prepare an expert opinion. In addition, you must have carried out work within the scope of your commission. • Timely billing or application Your claim to remuneration generally lapses if it is not asserted within a period of three months with the court or investigating authority that commissioned you. The time limit begins: • in the case of a written expert opinion, upon receipt of your expert opinion by the body that commissioned you, and • in the case of a hearing at a court hearing, upon its conclusion. In the case of repeated involvement (e.g. for continuation hearings), the time limit begins upon conclusion of the last hearing. • If the commission or involvement ends early, the time limit begins as soon as you have been notified of the early termination.

• Antrag auf Sachverständigenvergütung (Application for expert compensation) (under "Forms") • Auszahlungsauftrag (payment order) (original and one copy) • After you are dismissed from the appointment (Termin), you receive the signed "Auszahlungsauftrag" (payment order) (officially: HKR 174), which certifies your attendance. • Please submit the original and one copy of this "Auszahlungsauftrag" (payment order), together with the "Antrag auf Sachverständigenvergütung" (application for expert compensation) you have filled out, under the case reference number (Geschäftszeichen) of the proceedings. • Invoice for the written expert opinion (Gutachten) Please submit your invoice together with your written expert opinion, in duplicate, under the case reference number of the proceedings. • Proof of incurred travel costs or other expenses (original) Please provide proof of incurred expenses using the corresponding original receipts.

If you worked for the Kammergericht (Berlin Court of Appeal), you will be paid by that court; in all other cases, by the Amtsgericht Tiergarten (Tiergarten Local Court).
