• Initiation of proceedings To initiate a Mahnverfahren (order for payment procedure), you must apply to the competent European Order for Payment court (under "zuständige Behörden" [competent authorities]) for the issue of a payment order (Zahlungsbefehl). The application is subject to a specific form and can be submitted by various means.

• European payment order (Europäischer Mahnantrag) - apply for the issuance of a payment order (Zahlungsbefehl) (under "Online-Abwicklung" [online processing] or "Formulare" [forms]) • Print out and send the application by post: You can fill out the application in the eJustice Portal of the European Union, print it out, and send it by post. This method of submission is no longer permitted for lawyers, registered debt collection service providers, and, as of 01.01.2022, also for authorities and legal entities under public law (§ 130 d Zivilprozessordnung [Code of Civil Procedure]). • Send the application electronically: You can fill out the application in the eJustice Portal of the European Union and submit it using your Personalausweis (identity card) with the activated online identification function (eID), via the besonderes elektronisches Anwaltspostfach (beA) [special electronic lawyer mailbox], the besonderes elektronisches Notarpostfach (beN) [special electronic notary mailbox], the elektronisches Behördenpostfach (beBPo) [electronic authority mailbox], the elektronisches Bürger- und Organisationspostfach (eBO) [electronic citizen and organization mailbox], or via Mein Justizpostfach (MJP) [My Justice Mailbox]. • No further documents required Because the European order for payment procedure is a simplified procedure for undisputed claims, no evidence such as receipts, copies of contracts, etc. needs to be attached to the application.

• For the Mahnverfahren (dunning/debt collection procedure) only half the fee under the Gerichtskostengesetz (GKG, Court Fees Act) is incurred, but at least 38.00 euros (fee schedule item 1100 to § 34 GKG). • The court fees are based on the amount of the claim asserted. • Payment of the court fees can also be made by direct debit (Bankeinzug) if this is indicated accordingly in the application.

European Order for Payment Court Germany at the Amtsgericht Wedding (Wedding Local Court) • for applications against debtors with their place of residence or place of business in Germany. For consumer matters, the court with responsibility (Zuständigkeit) is the one where the consumer has their place of residence. Exceptions to this rule on responsibility are possible, however (e.g. agreement on jurisdiction, place of performance).
