Grundbuch (land register) - Owner or Erbbauberechtigter (holder of a heritable building right) - Entry

• Application The Grundbuchverfahren (land register procedure) is an application-based procedure. The application is submitted by the Notariat (notary's office) that notarized the purchase contract. • Prior registration The person who is selling or gifting the property must be registered in the Grundbuch (land register). Exception: The transferring person is the heir.

• Written application The application must contain the following information: • Property designation (Grundbuch or location designation) • The entries to be made in the Grundbuch (land register) • Notarial contract The agreement on the transfer of the property must be declared in a notarial contract. • Declaration of authorization (Bewilligungserklärung) The owner must expressly authorize the entry. This declaration of authorization must likewise be made in notarial form. • Other evidence Proof of representation (e.g. power of attorney from the owner, extract from the Handelsregister/commercial register), proof of legal succession (e.g. Erbschein/certificate of inheritance, notarial will). • Tax clearance certificate For every transfer of ownership, the steuerliche Unbedenklichkeitsbescheinigung (tax clearance certificate) from the responsible Finanzamt (tax office) must be submitted. • Negative certificate regarding the municipal right of first refusal under the Baugesetzbuch (Federal Building Code) For the sale of property, a certificate from the Land (federal state) or municipality is often required confirming that the municipal right of first refusal (gemeindliches Vorkaufsrecht) will not be exercised. • Property manager's consent In the case of the transfer of a condominium unit (Eigentumswohnung), the Hausverwaltung (property management) frequently must give its consent. • Consent in the case of Erbbaurechte (heritable building rights) For the transfer of an Erbbaurecht, the owner of the property must give consent.
