Land register (Grundbuch) - Deletion of charges and restrictions

• Application The land register procedure (Grundbuchverfahren) is an application-based procedure. Upon the death of the entitled person or a waiver of the right, no automatic deletion is carried out by the land registry office (Grundbuchamt).

• Löschungsantrag (application for deletion) The application must be submitted in writing. The owner is entitled to submit the application. The person whose right is to be deleted may also submit the application. In connection with purchase or gift contracts, the applications for deletion are in most cases submitted by the Notariat (notary's office). • Löschungsbewilligung (consent to deletion) or Sterbeurkunde (death certificate) The person entitled, e.g. to a Nießbrauchrecht (usufruct right), issues a declaration that the right may be deleted from the Grundbuch (land register). The deletion must be expressly approved. The approval must either be declared before a notary or the signature must be certified. If the person entitled has died, please submit a Sterbeurkunde (death certificate) together with the application.
