Compulsory enforcement (Zwangsvollstreckung) measures - enforcement of surrender

• Enforcement order (Vollstreckungstitel) You must have an enforcement order (Vollstreckungstitel) — a court decision with enforceable content. This includes, for example, judgments, orders (e.g., an award order from an auction), court settlements and notarial deeds. • The item to be surrendered must be described in the enforcement order in full detail. • Enforcement clause (Vollstreckungsklausel) You must have an enforcement clause. The clause is a note on the enforcement order that permits you to carry out compulsory enforcement against the debtor. It reads, for example: "The above certified copy is issued to the plaintiff for the purpose of compulsory enforcement." • The enforcement clause is generally issued on request by the authority that originated the enforcement order. It must bear the official title, be signed and sealed. • Service of the enforcement order The enforcement order must be served on the other party before, or at the same time as, the start of compulsory enforcement. Service (Zustellung) means a legally defined form of delivering documents. • Service of judgments and orders is generally carried out ex officio by the court. The corresponding service is then certified on the enforcement order or in the enforcement clause. • If you do not yet have proof of service, you can likewise instruct the Gerichtsvollzieher/in (court bailiff) to handle this. • Special requirements for compulsory enforcement • If you wish to enforce before the judgment or order becomes final and the decision is only enforceable against provision of security, you must attach to the enforcement application proof that the security has been provided. • If further special enforcement requirements must be met for the enforcement of your surrender claim, the Gerichtsvollzieher/in (court bailiff) will inform you of these after the assignment has been given. • Expiry of the eviction period, if applicable If your application concerns the surrender of an apartment and the other party was granted an eviction period (Räumungsfrist) in the judgment, the eviction may only be carried out after this period has expired.

The expenses for handing over an apartment or business premises with the involvement of a removal company regularly amount to several thousand euros. For the costs to be expected, the bailiff will usually require an appropriate advance payment of costs from you.
