Grundbuch (land register) - Registration of Erbbaurecht (heritable building right)

• Application Registering the Erbbaurecht (heritable building right) is an application-based procedure. The registration application is submitted by the notary. • Prior registration Only owners registered in the Grundbuch (land register) can grant an Erbbaurecht. • Rank The Erbbaurecht must be entered in the Grundbuch at the first rank without exception.

• Written application The application must contain the following information: • the property designation (Grundbuch or Lagebezeichnung - land register entry or location designation) • the entries to be made in the Grundbuch (land register) • Notarial contract The agreement on the Erbbaurecht (heritable building right) must be declared in a notarial contract with all parties present at the same time. You may be represented when making the declarations. • Tax clearance certificate For every Erbbaurechtsvereinbarung (heritable building right agreement), the steuerliche Unbedenklichkeitsbescheinigung (tax clearance certificate) from the Finanzamt Spandau (tax office, for Berlin only) must be presented. • Approval under the Preisklauselgesetz (Price Clause Act) For a term of up to 30 years, an approval under the Preisklauselgesetz (Price Clause Act) must be presented.

A full fee applies (Annex 1 KV 14121 GNotKG [Court and Notary Costs Act]). The value of the right is determined either by the value of the property including its buildings or by the annual value of the Erbbauzins (ground rent under a heritable building right). The amount is set out in § 34 GNotKG (Annex 2, Table B).
