Public procurement - application for re-examination proceedings before the Procurement Chamber

As a party interested in a public contract, above certain contract values (for Europe-wide procurement procedures), you can submit an application for review (Antrag auf Nachprüfung) to the responsible Vergabekammer (procurement tribunal). The Vergabekammer examines whether the public contracting authority has violated your rights by breaching procurement regulations. Procedure: Note: Although there is no requirement for legal representation in this court-like procedure, it may be helpful to seek legal advice before submitting the application. • Submit an application for review. The application must meet certain formal requirements. Please be sure to observe the "Hinweise zur Form der Antragsstellung" (notes on the form of the application) (under "Voraussetzungen" [requirements]). • The Vergabekammer investigates the facts of the case and examines the procurement files of the public contracting authority, provided the application is not manifestly inadmissible or unfounded. • The Vergabekammer generally decides at an oral hearing and establishes, by decision (Bescheid), whether you as the applicant have been violated in your rights, and takes suitable measures to remedy a violation of rights or to prevent damage to the interests concerned. • Against the decisions of the Vergabekammer of the State of Berlin, an immediate appeal (sofortige Beschwerde) can be lodged with the Kammergericht Berlin (Berlin Court of Appeal) within two weeks.
