Witnesses - applying for compensation in proceedings before specialized courts

• You were summoned as a witness to an appointment (Termin) and attended that appointment • You have not waived the Zeugenentschädigung (witness compensation) • Application within 3 months

• Application for compensation of witnesses in specialized court proceedings (Fachgerichtsbarkeit) Submit the application in writing by post or fax, or hand it in in person on site: • You will already receive the application together with the summons or at the appointment (Termin). Please submit it fully completed to the court. • Payment order and certificate of attendance The application also serves as the payment order once your attendance at the appointment has been certified, following your witness testimony or your release from the appointment. • The payment order and the certificate of attendance must be signed by the court or the presiding judge. • Certificate of loss of earnings Have you suffered a loss of earnings? Please have this certified by your employer on the application form. The loss-of-earnings certificate is part of the application you already received with the summons or at the appointment. • Proof of self-employment Are you self-employed? Please enclose appropriate proof of your self-employment with the application (e.g. trade licence/Gewerbeschein) and state your average monthly gross income from self-employed work as well as your regular working hours. • Credible evidence of freelance activity Are you working as a freelancer? Please provide suitable documents to substantiate your freelance activity and enclose them with the application. Please also state your average monthly income from freelance activity and your regular working hours. • Proof of travel costs or other expenses incurred Have you incurred travel costs or other costs in connection with attending the appointment? Please provide proof of travel costs for your outward and return journey to the appointment as well as other expenses by means of appropriate receipts (e.g. original tickets, booking confirmations, invoices for flight tickets, accommodation costs).

Have you received a summons from the Sozialgericht Berlin (Berlin Social Court)? • Then you can submit your fully completed, written application in person at the registry office (Geschäftsstelle), place it in the mailbox of the Sozialgericht Berlin, or send it by post, fax, or, in compliance with the requirements for electronic legal communication under the relevant provisions, to the sender of the summons. Have you received a summons from the Verwaltungsgericht Berlin (Berlin Administrative Court)? • Then you can submit your fully completed application in writing, or in person at the Vergütungs- und Entschädigungsstelle (Remuneration and Compensation Office) on the ground floor, Room 0408, or at the administration office on the 1st floor, Room 1508.
