Requirements

• Review prior to commencing the activity pursuant to § 11a paragraph 1 • Information provided by the party commissioning the work (Veranlasser) • The date of the start of construction or the year of construction • Whether the activities to be carried out are permitted under § 11 or § 17 paragraph 1 • Whether the activities could lead to a release of asbestos fibers • Whether, taking into account the planned protective measures, the activities are carried out in the low, medium, or high risk category • Staffing As a specialist company (Fachbetrieb), you need employees with professional qualifications (Fachkunde) and expert knowledge (Sachkunde). The certificate of expert knowledge (Sachkundenachweis) requires successful completion of an officially recognized expert knowledge course (Sachkundelehrgang). The certificate of expert knowledge (Sachkundenachweis) is then valid for six years: • The identification and assessment of hazards, the determination of the necessary protective measures, and the provision of instruction must be carried out by a person who holds expert knowledge (Sachkunde) under Annex I No. 3.7. If you, as the employer, do not yourself hold the required expert knowledge (Sachkunde), you must designate a competent responsible person within the company to fulfill these tasks. • Activities involving asbestos must be supervised by a person with the authority to issue instructions who holds expert knowledge (Sachkunde) under Annex I No. 3.7; this supervising person must be present on site at all times while the activities are being carried out. • The activities may only be carried out by employees who hold professional qualifications (Fachkunde) under Annex I No. 3.6. The Fachkunde qualification becomes mandatory from 05.12.2027 (including proof of acquisition of the theoretical and practical basic knowledge as part of the Fachkunde). • Technical safety equipment As a specialist company (Fachbetrieb), you need the technical equipment required under TRGS 519 (Technical Rules for Hazardous Substances No. 519). The type and scope of the notification depend on the risk category of the activities. For activities in the high-risk category, you also need an authorization (Zulassung) under § 11a paragraph 3 in conjunction with Annex I No. 3.4.

Documentation of the risk assessment, the work plan. • The notification is valid for 6 years, but must be resubmitted before any change in working conditions that could lead to a significant increase in employees' exposure. • Asbestos notification (site-related) for the high-risk area (see form) In addition, under the new regulations the following must be enclosed: 1. Specification of the risk area, including the type of exposure assessment, 2. Number of qualified employees, 3. Measures to limit employees' asbestos exposure, 4. Details of the responsible person and the supervising person. 5. Proof of qualification of the responsible person and the supervising person 5a. Documentation of the risk assessment, the work plan. • Stationary workplaces operating in the high-risk area do not require a notification. • Supplementary asbestos notification regarding place and time For changing workplaces, for activities in the medium-risk area, the location of the workplace as well as the start and duration of the activities must be reported in addition to the company-related notification.
