Solarpflicht (solar obligation) - Apply for an exemption

• Start of construction after 31.12.2022 • Non-public building with a usable floor area of more than 50 square meters You are the owner of a non-public building. At a usable floor area of 50 square meters or less, the Solarpflicht (solar obligation) does not have to be met; in that case you do not need to submit an application. • Type of building subject to the Solarpflicht (solar obligation) You do not need to submit an application if your building falls into one of the following categories, because these categories are exempt from the Solarpflicht: • underground structure, • glasshouse facility or cultivation building for raising, propagating, and selling plants (greenhouse), • air-supported hall (Traglufthalle) or temporary structure (fliegender Bau), • garage or ancillary structure located on the same plot of land as another building through which the Solarpflicht is fulfilled. • An exemption or partial exemption may be possible for the following reasons, for example: • Extraordinary burden: The Solarpflicht represents an extraordinary financial burden for you as the building owner. • Lack of financing: As the building owner, you do not have sufficient own funds to finance a photovoltaic system or a solar thermal system and cannot obtain a loan from a bank. • Unreasonably high expense: Extensive and costly conversion measures, or unreasonably high follow-up costs, arise. • Extreme disproportion: An extreme disproportion arises between the costs of fulfilling the Solarpflicht and the costs of the essential roof conversion work. • Roof area: Due to mandatory rooftop fixtures, relevant shading, or similar factors, the roof area is not sufficient to install a photovoltaic system in accordance with the requirements of the Solargesetz (Solar Law). For the portion of the Solarpflicht that cannot be fulfilled, a partial exemption may be considered.
