Benefits under the Asylbewerberleistungsgesetz (Asylum Seekers' Benefits Act) - Advice

• You are a foreign national, are actually present in the federal territory, and hold a specific Aufenthaltstitel (residence permit) sozialrecht.berlin.de/kategorie/rundschreiben/rs-soz-03-2026 A foreign national is entitled to benefits if they hold one of the following residence permits: • AE (Aufenthaltserlaubnis – residence permit) under § 23 (1) AufenthG (Aufenthaltsgesetz [Residence Act]) (admission of groups of persons) • AE under § 24 AufenthG (temporary protection in the event of mass influx pursuant to EC Directive 01/55/EG) • AE under § 25 (4) sentence 1 AufenthG (urgent humanitarian/personal reasons) • AE under § 25 (5) AufenthG, provided the Duldung (toleration/suspension of deportation) has not been suspended for 18 months or more (legal or factual obstacles to departure whose removal is not foreseeable) • Suspension of deportation (Duldung) under § 60a (1) AufenthG (group regulation) • Suspension of deportation (Duldung) under § 60a (2) AufenthG (legal or factual obstacles to departure whose removal is foreseeable, or where the person is themselves responsible for the obstacle) • Residence is deemed tolerated under § 71a (3) in conjunction with § 71 AsylVfG (Asylverfahrensgesetz [Asylum Procedure Act]) (subsequent asylum application) • Residence is deemed tolerated under § 71a (3) AsylVfG (second asylum application)
