State supervision - submit a complaint about the Industrie- und Handelskammer (IHK, Chamber of Industry and Commerce) Berlin

If the Industrie- und Handelskammer zu Berlin (IHK Berlin, Chamber of Industry and Commerce) fails to comply with applicable law, whether intentionally or inadvertently, you can file a complaint with the Rechtsaufsicht (legal supervisory authority). The Rechtsaufsicht examines matters relating to the IHK Berlin. However, it is not the task of the Rechtsaufsicht to enforce individual members' claims or to provide individual legal advice like a lawyer (Rechtsanwalt). It acts "exclusively in the public interest," meaning the complaint does not replace legal action (Klage, lawsuit) or the legal remedy stated in the notice (Bescheid) (e.g. an objection/Widerspruch). Procedure: • You submit your complaint in text form to the Staatsaufsicht Berlin (State Supervisory Authority). You can do this online. You should state the facts of the matter specifically. • The complaint is reviewed; if necessary, you will be contacted with follow-up questions. • The complaint may be forwarded to the IHK Berlin with a request for review and for a written statement (Stellungnahme). This is ultimately sent back to the Staatsaufsicht. • You will receive a final notification (Abschlussmitteilung) regarding your complaint from the Staatsaufsicht.
